RoamLink Enterprise Wireless Terms of Service (Version 2)

1. Introduction

Welcome to RoamLink Enterprise Wireless, a business-grade wireless internet service designed specifically for commercial, industrial, and organizational use. By activating or using RoamLink Enterprise Wireless services (“Services”), you agree to comply with and be bound by the following Terms of Service (“Terms”). Please review them carefully.

These Terms apply exclusively to RoamLink Enterprise Wireless business plans, which are intended solely for use by businesses, governmental agencies, NGOs, and other commercial entities. If you are seeking terms for a consumer or residential plan, please refer to the RoamLink Wireless Consumer Terms of Use

2. Services Provided

RoamLink Enterprise Wireless provides business-grade wireless data services for commercial use, including but not limited to corporate connectivity, IoT deployments, SD-WAN/failover integrations, branch office connectivity, mobile workforce deployment, fleet solutions, and enterprise mobility applications.

RoamLink Enterprise Wireless offers two primary types of plans:

  • Metered Enterprise Plans – Plans with a defined number of monthly or pooled gigabytes (“GB”) of data. Metered plans are not subject to abuse clauses, speed tiering, or usage-based network management policies beyond those required for general network health, carrier compliance, and security.
  • Unlimited Enterprise Plans – Plans offering unlimited data usage. Unlimited plans are subject to network management, abuse prevention, and prioritization policies as outlined in these Terms.

All RoamLink Enterprise Wireless plans remain subject to real-world conditions inherent to cellular networks, including tower load, congestion, environmental factors, carrier policies, and other conditions outside RoamLink’s direct control.

3. Acceptable Use

By activating or using RoamLink Enterprise Wireless, you agree not to engage in any activities that violate laws, interfere with network performance, compromise security, or misuse network resources. Prohibited activities include, but are not limited to:

  • Violating any local, state, federal, or international law or regulation.
  • Interfering with the stability, performance, or availability of the network.
  • Compromising the security or integrity of any network, device, or account.
  • Transmitting malicious code, engaging in hacking or denial-of-service attacks, or distributing malware.
  • Sending unsolicited bulk communications (spam) or abusive traffic.
  • Attempting to circumvent network controls, SIM protections, or policy enforcement mechanisms.
  • Generating unreasonable or disproportionate network load using automated or machine-driven traffic patterns.

Metered Enterprise Plans: Not subject to behavioral usage limits beyond those necessary to protect core network stability, security, and carrier compliance.

Unlimited Enterprise Plans: Subject to fair-use controls and network management practices as described in Sections 4, 5, and 6 to ensure equitable access to network resources for all customers.

4. Network Management

RoamLink Enterprise Wireless may manage bandwidth and network resources to ensure overall service reliability and performance. Network management practices may include prioritizing essential business traffic, mitigating congestion, adjusting throughput, and managing or limiting non-essential high-bandwidth activities in order to protect overall network health.

Unlimited Enterprise Plans: May experience network management practices including traffic prioritization, temporary speed reductions, or other reasonable measures to address congestion or abusive usage patterns.

Metered Enterprise Plans: Not subject to throttling, speed tier enforcement, or usage-based network management beyond carrier-required actions and measures necessary to protect the integrity and security of the network.

5. Speed Tiers

Some RoamLink Enterprise Wireless plans may include optional or enforced speed tiers. A speed tier defines the maximum upload and download speeds that may be available on a given plan and is not a guarantee that the plan will operate consistently at those speeds. Speed tiers apply primarily to Unlimited Enterprise Plans or those plans where such tiers are explicitly stated.

Speed tiers may be used to promote cost efficiency, manage total usage, or enforce network management policies while typically not adversely impacting real-world performance for most business applications. All speeds are subject to network availability, signal strength, carrier traffic, and other environmental factors commonly associated with cellular networks.

6. Data Usage Limits

Metered Enterprise Plans: For metered plans, usage is limited to the allocated or pooled data amount defined in your agreement or rate plan. Overages may result in additional usage charges, throttling, or other actions as specified in your service order or plan description.

Unlimited Enterprise Plans: For Unlimited Enterprise Plans:

  • Customers may be throttled to reduced speeds after reaching usage thresholds outlined in their plan details or in published policies.
  • Customers on an unlimited rate plan with a daily average of more than 20 GB over any 7-day rolling period may be contacted by RoamLink for optimization guidance to maintain quality service for all customers.
  • Continued excessive usage without cooperation or implementation of recommended adjustments may result in additional network management measures or termination of service at RoamLink’s sole discretion.
  • Unlimited Enterprise Plans may require FusionSIM capable Peplink hardware and/or multi-modem devices at each location.

7. Roaming Agreements and Peplink FusionSIM Technology

RoamLink Enterprise Wireless utilizes commercial roaming agreements with various carriers and Peplink FusionSIM technology to provide multi-carrier redundancy, routing optimization, and enhanced service stability. FusionSIM allows efficient management of multiple SIM cards and network links, particularly for high-usage customers or deployments using multiple concurrent network paths.

Customers consuming more than 300 GB of data per month or using multi-WAN configurations may be provisioned with or benefit from FusionSIM-based routing and traffic management to maintain performance and cost-effectiveness.

8. Changes to Services and Agreement

RoamLink Wireless reserves the right to change, limit, suspend, or terminate your Enterprise Service or this Agreement at any time, including if you engage in any prohibited uses described in these Terms, fail to comply with your payment obligations, violate applicable law, or engage in harassing, threatening, abusive, fraudulent, or offensive behavior.

If your Service, product, or account is limited, suspended, or terminated and then later reinstated, you may be charged a reconnection fee. Your account may continue to accrue charges even if the Service is suspended. You are responsible for any charges incurred while your Service or account is active or suspended.

Under certain limited circumstances, we may block your device or SIM from working on our network. If a change to your Service or rate plan will have a material adverse effect on you, we will typically provide 14 days’ notice of the change. Your continued use of the Service after the effective date of such changes constitutes your acceptance. We may exclude certain types of traffic, calls, messages, or sessions (for example, certain conference or chat lines, broadcast or high-risk traffic profiles) at our sole discretion without further notice.

9. Privacy Policy

Your privacy is important to us. Please refer to our applicable Privacy Policy for Enterprise customers for information on how we collect, use, disclose, and protect your information in connection with RoamLink Enterprise Wireless services.

10. Limitation of Liability

RoamLink Wireless shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising out of or related to the use of, or inability to use, RoamLink Enterprise Wireless services. This includes, but is not limited to, damages for loss of data, loss of profits, business interruption, or any other commercial damages or losses, even if RoamLink has been advised of the possibility of such damages.

You acknowledge that wireless and cellular networks are inherently variable and that service may be affected by factors beyond RoamLink’s control, including carrier outages, congestion, equipment limitations, physical obstructions, and environmental conditions.

11. Modifications to Terms

RoamLink Wireless may modify these Terms at any time. Any changes will be posted on our website or otherwise communicated to you in accordance with your service agreement. Unless otherwise stated, modifications become effective upon posting. Your continued use of RoamLink Enterprise Wireless services after the effective date of any changes constitutes your acceptance of the revised Terms.

12. Sales Tax

RoamLink Enterprise Wireless services may be subject to federal, state, and local taxes, fees, or surcharges depending on your jurisdiction, service configuration, and use case. Customers are responsible for paying all applicable taxes and fees unless valid exemption documentation is provided and accepted by RoamLink. Tax treatment may differ from consumer service and may not fall under the same exemptions.

13. 7-Day Money-Back Guarantee

Enterprise customers may be eligible for a refund on RoamLink Enterprise Wireless services if they request cancellation within 7 days of activation and have used less than 20 GB of data during that period. Any refunds for associated equipment, hardware, or managed services are subject to the specific return, RMA, or cancellation policies outlined in your purchase agreement or service order.

14. Service Level Commitments (SLA)

RoamLink Enterprise Wireless provides commercial-grade service but does not guarantee specific uptime or performance due to the inherent variability of cellular networks. At RoamLink’s discretion, limited service-level credits may be made available in cases of prolonged, RoamLink-controlled outages exceeding 24 consecutive hours, excluding carrier-level disruptions, force majeure events, and environmental conditions beyond our control.

15. Business Support & Escalation

Enterprise customers receive access to business-focused support resources, which may include priority ticket routing, business-hours phone support, and access to experienced technical personnel. Optional 24/7 emergency response coverage, enhanced SLAs, or dedicated account management may be available under separate agreements or for qualifying accounts.

16. Equipment Ownership, Deployment & RMA

Unless otherwise agreed in writing:

  • Customer-purchased equipment (such as routers, antennas, or CPE devices) is owned by the customer.
  • Leased or loaned equipment provided by RoamLink remains the property of RoamLink or its suppliers and must be returned in good condition upon service termination or equipment replacement.
  • Return Merchandise Authorizations (RMAs) generally cover manufacturer defects within applicable warranty periods, subject to the terms of the underlying hardware vendor.
  • Managed routers or devices may include required remote management software or configuration profiles that must not be removed, disabled, or tampered with while under an active managed service agreement.

17. Security Responsibilities

Customers are responsible for maintaining the security of their own networks, devices, and credentials, including implementation of appropriate firewall rules, encryption, access controls, and device hardening appropriate for their environment.

  • You are responsible for preventing unauthorized access to your routers, IoT devices, and network infrastructure.
  • You must protect SIMs, login credentials, management interfaces, and API keys from unauthorized use.
  • Improper use of public IP assignments, if provided, is prohibited.
  • RoamLink may block traffic or restrict service if your devices or accounts are compromised or if your traffic poses a security risk to the network or other customers.

18. Contract Term, Renewal & Termination

Enterprise plans may be offered on a month-to-month, annual, or multi-year basis. The specific term, renewal conditions, and termination rights will be defined in your order form, master service agreement, or other governing contract documents.

Early termination fees may apply if you cancel service prior to the end of any committed contract term. RoamLink may terminate or suspend service for cause, including but not limited to non-payment, breach of these Terms, or misuse of the service.

19. Business Continuity & Failover

RoamLink Enterprise Wireless can be used as a primary connectivity solution, a secondary/failover link, or as part of an SD-WAN or multi-WAN architecture. While these designs can improve resilience and uptime, performance and availability during carrier outages, disasters, or large-scale events are not guaranteed.

20. Billing, Invoicing & Payment Terms

Invoices for RoamLink Enterprise Wireless services may be issued on a monthly, annual, or other agreed billing cycle. Unless otherwise stated in your agreement, payment is due upon receipt of invoice. Late payments may result in late fees, finance charges, suspension of service, or termination, at RoamLink’s discretion and in accordance with applicable law.

21. Prohibited Resale of Service

Enterprise customers may not resell, redistribute, or otherwise provide RoamLink Enterprise Wireless services to third parties on a standalone basis without an executed and authorized reseller, wholesale, or white-label agreement with RoamLink. Use of the service as backhaul or internal connectivity for your own business operations or end users under your control is permitted, provided it is consistent with these Terms.

22. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Hampshire, without regard to its conflict of law principles.

24. Acceptance of Terms

By using RoamLink Enterprise Wireless services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, as well as any additional documents or policies referenced herein or incorporated by reference.
